Item Anexos: Relación de largo plazo de la inversión extranjera directa en Costa Rica 1991–2016(LEAD University, 2019) Zolezzi, Sandro; Miranda, Mauricio; Chacón, AdrianaItem Mitos sobre los acuerdos internacionales de inversión: "rescatando" a los países en desarrollo del desarrollo(LEAD University, 2020-01) Echandi, RobertoEste ensayo pretende resaltar el papel clave del derecho internacional de la inversión para los países en desarrollo en tiempos de globalización. No argumenta que el régimen de inversión internacional actual sea perfecto, ni que no requiera ajustes. Lo que se argumenta aquí es que, independientemente de cómo las relaciones de poder definieron las características del derecho internacional de la inversión en los siglos XIX y XX, los paradigmas de inversión en el siglo XXI se han transformado radicalmente facilitando el crecimiento de las economías en desarrollo. Por primera vez en la historia, una serie de países en desarrollo están industrializándose y diversificando sus economías y exportadores de bienes y servicios hacia sectores de mayor valor agregado. Esto ha sido posible gracias a las Cadenas Globales de Valor (CGV) que a su vez se materializan a través de la Inversión Extranjera Directa (IED). Está surgiendo un mundo multipolar económico y no solo el flujo de IED hacia adentro, sino hacia afuera de las economías tiene mucho que ver en este proceso. Paradójicamente, justo cuando los países en desarrollo finalmente están aprendiendo a insertarse en una economía globalizada y a aprovechar las normas internacionales para promover ese proceso, muchos sectores en los países desarrollados que no están acostumbrados a que el derecho internacional limite la total discreción que históricamente han disfrutado en su quehacer normativo y político, están reaccionando con dureza contra el mismo derecho de la inversión que contribuyeron a crear. En este contexto radicalmente nuevo, argumentar que un sistema de gobernanza internacional es solo una manifestación del imperialismo implica el riesgo de “rescatar” a los países en desarrollo del mismo desarrollo.Item Donald Trump vs. Xi Jinping Estados Unidos vs. China(LEAD University, 2020-01) Lizano Fait, EduardoLa presencia de Donald Trump y Xi Jinping, máximos representantes de EE.UU. y China en el escenario internacional, ha sido un acontecimiento de gran trascendencia para las relaciones internacionales. Ellos dos han liderado a su país en la lucha, sin cuartel, por la hegemonía mundial. Esta pugna abarca temas como: el comercio, las finanzas, la cultura, el desarrollo tecnológico y las fuerzas militares. Este documento se refiere específicamente, al tema de las relaciones comerciales entre ambos países y el posible efecto para Costa Rica.Item Acciones estratégicas para profundizar la integración económica en Centroamérica(LEAD University, 2020-01) Ocampo, FernandoCentroamérica cuenta con un mercado dinámico que crece constantemente y plantea nuevas demandas para las empresas y las autoridades de la región. En ese contexto, es necesario que el proceso de la integración económica centroamericana sea capaz de responder ante los cambios presentan, promueva la competitividad y mejore el clima de negocios del área, para así beneficiar a las partes involucradas en el comercio del istmo. Por estas razones, el presente escrito señala cinco acciones estratégicas para profundizar la integración económica centroamericana, tomando en cuenta áreas como la homologación de requisitos, el libre movimiento de mercancías y la armonización de la legislación regional. Dichas acciones son: a) profundizar los procesos de reconocimiento de registros sanitarios; b) fortalecer la Directriz Sanitaria y Fitosanitaria Centroamericana; c) analizar las regulaciones aplicables al intercambio comercial de las mercancías producidas en Regímenes Aduaneros Especiales; d) ampliar el porcentaje de armonización de las Normas De Origen Centroamericanas a la luz de las Normas De Origen negociadas en los distintos Tratados de Libre Comercio suscritos por los países de la región; y e) disminuir la cantidad de partidas no armonizadas del Arancel Centroamericano de Importación, a la luz de los programas de desgravación de los principales Tratados de Libre Comercio. Las siguientes páginas detallan dichas acciones y muestran los posibles impactos de su implementación, por lo tanto, se espera que este documento sirva como base para una amplia discusión sobre algunos de los retos más importantes de la integración centroamericana en la actualidad.Item ¿Cómo está afectando la automatización a los sectores de exportación en Costa Rica?(LEAD University, 2020-01) Monge González, RicardoEste artículo resume los hallazgos de una investigación pionera sobre los impactos de la automatización en la competitividad y empleo en tres sectores de exportación de Costa Rica: Alimentos, Tecnologías de Información y Comunicaciones, y Servicios Offshore. Mediante encuestas estructuradas se recopiló información a muestras representativas de empresas de estos sectores. Los resultados muestran que la automatización es un fenómeno ya en proceso en Costa Rica, pero con diferentes grados de avance entre los sectores estudiados. El sector que muestra menor grado de avance es el de alimentos. En todos los casos el principal promotor de la automatización es la mejora en la competitividad. Los impactos de este proceso sobre el empleo difieren entre los sectores, aunque en todos ellos se observa la creación de nuevas oportunidades de empleo. Importantes retos son identificados para que las empresas y los trabajadores salgan airosos ante la automatización. Varias recomendaciones de política se plantean al respecto.Item Relación de largo plazo de la inversión extranjera directa en Costa Rica 1991–2016(LEAD University, 2020-01) Zolezzi, Sandro; Miranda, Mauricio; Chacón, AdrianaLa relación de la inversión extranjera directa sobre variables macroeconómicas ha sido empíricamente ambigua. La literatura académica ha debatido sobre si la inversión extranjera directa tiene efectos positivos, negativos o nulos en la economía receptora. El presente estudio muestra que la relación de largo plazo de la inversión extranjera directa que llega a Costa Rica sobre el crecimiento económico, las exportaciones totales y el número de ocupados ha sido positiva y estadísticamente significativa. En comparación con la inversión extranjera directa que llega al resto del país, entiéndase como el Régimen Definitivo, la inversión extranjera directa asentada en Zona Franca ha tenido un efecto mayor sobre las exportaciones de servicios y en el número de ocupados. Mediante una combinación de datos históricos y estimados se realizó un ejercicio econométrico que identificó las elasticidades utilizando series de tiempo con mínimos cuadrados ordinarios (MCO) y un modelo ARMAX.Item Una nueva fase en las relaciones entre China y Latinoamérica: Cooperación en ciencia, tecnología e innovación(LEAD University, 2020-01) Salazar-Xirinachs, José ManuelAdemás de gran socio comercial, fuente de inversión extrajera directa y gran constructor de infraestructura, China es cada vez más una potencia tecnológica. Este artículo argumenta que ha llegado el momento para una mayor cooperación en ciencia, tecnología y educación para la innovación entre China y América Latina, y explora algunas áreas concretas de oportunidad. Sin embargo, este potencial estará fuertemente influenciado por la evolución de las relaciones entre los EE. Mientras se desarrollan diferentes escenarios, el comercio administrado está ganando terreno, las reglas están cada vez más fragmentadas en diversas esferas de influencia y la gobernanza del comercio mundial se está debilitando. La Organización Mundial de Comercio se encuentra bajo una tensión significativa y el entorno empresarial es más incierto, volátil y cada vez más impulsado por el poder. En estas condiciones, la búsqueda de un sistema comercial mundial renovado es fundamental para apoyar el crecimiento, el avance tecnológico y la estabilidad mundial.Item ¿Hace el inglés más empleable a las personas?(LEAD University, 2020-01) Abarca Garro, Alejandro;En este trabajo, mediante modelos econométricos y un análisis de componentes principales, se estudia en qué medida las personas que saben hablar inglés tienen mayores probabilidades de estar empleadas, de trabajar en el sector formal de la economía y menores probabilidades de ser subempleadas que las personas que no lo hablan en Costa Rica. Se encuentra que saber inglés no está asociado con un tener una mayor probabilidad de estar empleado ni de no estar subempleado. Por otro lado, se encuentra que saber inglés está asociado con una menor probabilidad de trabajar en el sector informal de la economía. Los resultados sugieren entonces que el inglés por sí mismo no mejoran la empleabilidad de las personas, pero permite a los trabajadores obtener trabajos en el sector formal de la economía, los cuales tienen mejores beneficios.Item Intel “Inside”: Midiendo su impacto de largo plazo en el desarrollo de Costa Rica usando un método de control sintético(Editorial ULEAD, 2020-07) Zolezzi Hernández, Sandro; Miranda Bao, Mauricio¿Cuál ha sido el efecto causal de Intel en el desarrollo económico de Costa Rica? O más bien ¿Cuál hubiese sido el desarrollo de Costa Rica si Intel no hubiese abierto operaciones en el país? Responder a la primera pregunta y a su escenario contrafactual son los principales objetivos de este estudio. A pesar de que Intel tiene más de veinte años de operar en Costa Rica, no se ha cuantificado su impacto sobre el PIB per cápita real mediante un control sintético. En los últimos años, se han publicado varios estudios sugiriendo un efecto positivo de Intel en la economía doméstica, pero ninguno ha diseñado un escenario contrafactual con el cual comparar dicha operación. Cualitativamente, se tiene conocimiento de que la empresa ha aportado una larga lista de beneficios positivos al país, tanto directos como indirectos. Cuantitativamente, a través de un control sintético, se determina que con Intel el crecimiento promedio anual del PIB per cápita real de Costa Rica aumentó en promedio de 1,3% a 2,6% anualmente durante el periodo 1998-2018, más que duplicando el crecimiento en comparación con una Costa Rica contrafactual que no hubiese recibido la inversión de IntelItem Migrantes de Bolivia, Paraguay y Perú residentes en São Paulo (Brasil) y las remesas enviadas a sus países de origen(Editorial ULEAD, 2020-07) Céspedes Torres, OswaldEl análisis de la migración Sur-Sur, como lo sería el caso de migrantes de países sudamericanos (Bolivia, Paraguay y Perú, aquí denominado Bloque BPP) hacia Brasil, es un tema del mayor interés, especialmente si se observan las tendencias de la evolución migratoria en otros destinos como el europeo (especialmente España) como consecuencia de diversos factores, entre ellos, la crisis económica internacional del 2008 y la recesión económica cuyos efectos han sido fuertemente sentidos por muchos migrantes en términos del desempleo y caída de sus ingresos. Los efectos recesivos, junto con la devaluación de la moneda (tanto el Euro como el Real) en los años analizados, han sido determinantes de los menores flujos de remesas enviados desde España (y EE.UU.) y, a pesar de haber mayores flujos de migrantes hacia Brasil, estos no han sido suficiente para compensar estas caídas en las remesas recibidas por los hogares de los migrantes en Bolivia, Paraguay y Perú. Ante este panorama, un estudio como el presentado en este documento es de sumo interés con el fin de conocer en mayor profundidad las principales características de la población de migrantes del Bloque BPP residentes de São Paulo, Brasil.Item ¿Cómo cambian los ingresos tributarios en Costa Rica cuando cambia la actividad económica?(Editorial ULEAD, 2020-07) Lankester Campos, Valerie; Loaiza Marín, KerryEn la formulación de la política fiscal, no es una persona la que decide e implementa cambios, pero un grupo de personas e instituciones de Gobierno se ven involucradas. La organización entre ellos es un reto en sí mismo, que de alguna manera se puede facilitar cuando se inicia desde un punto común: la mejor información disponible, de robustez técnica y metodologías comprobadas. Bajo ese marco, es el objetivo de esta nota técnica poder ofrecer al lector la respuesta a cómo cambian los ingresos tributarios en Costa Rica cuando hay cambios en la actividad económica con una caracterización, por magnitud y dirección, de su comportamiento al estimar las elasticidades. Esto se hace con base en la metodología propuesta en la investigación sobre multiplicadores fiscales de Blanchard y Perotti (2002) y con datos para Costa Rica desde el año 1991. Los resultados muestran entonces la elasticidad tributaria de corto y largo plazo por tipo de impuesto. En donde la primera, está entre 1,11 y 1,22 en promedio y dependiendo del método de estimación (directo o indirecto) y la segunda, entre 0,96 y 1,30Item Viabilidad de las asociaciones público-privadas en la infraestructura social (appis) en Costa Rica(Editorial ULEAD, 2020-07) Matamoros Carvajal, GuillermoLas Asociaciones Público-Privadas de Infraestructura Social (APPIS), constituyen un modelo de gestión de infraestructura y servicios en salud, educación, cultura, seguridad, espacios públicos y similares, concepto que va más allá de los elementos físicos y que más bien actúan como un mecanismo para unir a las personas y construir capital social, convirtiéndose en espacios donde se forman las conexiones sociales que cohesionan a los ciudadanos alrededor de una situación o necesidad común. Las APPIS son contratos de largo plazo, donde los sectores público y privado unen esfuerzos para desarrollar una obra, equipos, sistemas, y productos o bienes complejos, haciéndose una adecuada distribución de riesgos, comprometiéndose el privado a mantener operando la obra, sistema o producto en las condiciones pactadas, y si procede prestando los servicios asociados a ellos. Producto de este negocio, el público se compromete a pagar una suma periódica (Pago Por Disponibilidad –PPD–), pagos per cápita o fee por servicios, al privado. En el caso de Costa Rica, la viabilidad de las APPIS no encuentra una barrera jurídica, e incluso en la experiencia de sectores como el de salud, se ha avanzado de manera importante en la ejecución de proyectos bajo esta modalidad, con proyectos de bata blanca, verde o gris. Se cuenta con una cartera de proyectos de cierto volumen y que responden a necesidades apremiantes que enfrentan los y las ciudadanas. Por ello, se analiza la factibilidad que existe en los temas de salud y educación.Item Prácticas monopolísticas absolutas en la ley y jurisprudencia de Costa Rica(Editorial ULEAD, 2020-07) Thompson Chacón, AlanLa Ley N° 7472 sobre competencia en Costa Rica recién cumplió 25 años. Se aprobaron reformas importantes en 2008, con normas especiales para el sector telecomunicaciones; en 2012, introduciendo el control previo de concentraciones; y en 2019, con la Ley N° 9736 que fortalece a las autoridades, cambia procedimientos, aumenta sanciones e introduce el programa de clemencia para combatir carteles. En relación con la investigación y sanción de carteles (la ley costarricense usa el término “prácticas monopolísticas absolutas”), la ley prevé la aplicación de la “regla per se” a carteles de núcleo duro, lo cual ha sido con firmado por la jurisprudencia. La autoridad de competencia ha sancionado 16 casos de prácticas monopolísticas absolutas. La mayoría de esas resoluciones han quedado firmes en la vía administrativa o han sido confirmadas en la vía judicial, pero en algunas los Tribunales han anulado parcial o totalmente lo resuelto por la autoridad de competencia, ya sea por insuficiente fundamentación de las sanciones impuestas o con base en una distinta valoración de la prueba sobre la existencia de la conducta ilegal.Item Universalización de las pensiones por vejez en Costa Rica(Editorial ULEAD, 2020-07) Sauma Fiatt, PabloEn diciembre de 2018, 332.194 personas adultas mayores (65 años y más) contaban con una pensión por vejez, contributiva o no contributiva, para una cobertura efectiva de entre el 59% y el 79% de la población de esa edad –el resultado depende de la proyección de población que se utilice–. En cualquiera de los dos casos, el país enfrenta el reto de lograr la cobertura universal de este tipo de pensiones. Se propone otorgar una pensión no contributiva, con cargo al presupuesto nacional, a toda la población adulta mayor que no perciba una pensión por vejez, ya sea contributiva o no contributiva. Se realizó una estimación preliminar del costo total de esa propuesta, considerando el monto de la pensión mensual que brinda el Régimen no Contributivo de Pensiones administrado por la Caja Costarricense de Seguro Social. Utilizando como referencia el PIB del año 2019, el resultado de esa estimación representa entre un 0,30% y un 0,78% del mismo, magnitudes razonables para el país, pero sujetas a limitaciones impuestas por la situación fiscal.Item Crisis, reactivación económica e inversión. ¿Cuáles son los desafíos?(Editorial ULEAD, 2020-07) Loría Sagot, MiguelComo muchos países en el mundo, Costa Rica enfrenta nuevos y grandes desafíos a raíz de la crisis provocada por el Covid-19. Una fuerte contracción en la actividad productiva, elevado desempleo, presiones adicionales sobre la deuda pública y un incremento en la pobreza son los resultados que se esperan en el corto plazo. Si bien el consumo de bienes y servicios es la prioridad, para el mediano y largo plazo el país requiere una estrategia que potencie el crecimiento y la generación de empleos, basada en la acumulación de capital y el ahorro nacional. Se discuten los principales desafíos que enfrenta la economía costarricense para lograr tasas de crecimiento sostenidas que permitan incrementar empleos y reducir la pobreza, una vez superada la crisis provocada por la pandemia. Incrementar las tasas de inversión real es una condición necesaria pero no su ciente para alcanzar esos objetivos. dadas las restricciones para elevar los ya elevados niveles de endeudamiento público, la e ciencia del sistema financiero para movilizar el ahorro nacional es un aspecto crítico. Asimismo, el manejo y la rendición de cuentas en los proyectos de inversión pública exigen un cambio en la cultura gerencial en el país: pasar de una rendición de cuentas contable a una gestión por resultados para el desarrollo. En el estudio se documentan los principales hallazgos, y se sugieren algunos temas no explorados, pero que por su relevancia merecen ser abordados en futuras investigaciones.Item Facilitación del comercio en tiempos de crisis(Editorial ULEAD, 2020-07) Santamaría Guerrero, Viviana; Zúñiga Hernández, Juan Luis;¿Qué implica para un operador de comercio un día de demora en una frontera o en un puerto? ¿Quiénes pagan las consecuencias causadas por esas demoras? ¿Por qué en plena era digital, algunos países insisten en los excesos de trámites y papeleos para autorizar una operación de comercio internacional? ¿Tienen valor las políticas de facilitación del comercio? ¿Qué debería ocurrir con esas políticas en tiempos de crisis, como la ocurrida con la pandemia del Covid-19? La excesiva burocracia incrementa los costos y gastos para las empresas debido, entre otras, a las demoras y “tiempos muertos” causados en puertos, aeropuertos y fronteras. Con el objetivo es impulsar el comercio mundial, en 2013, después de casi 10 años de conversaciones, concluyeron en la OMC las negociaciones relativas al Acuerdo sobre Facilitación del Comercio (AFC). Frente a la actual crisis del COVID-19, algunos han reaccionado rápidamente con protocolos temporales que han permitido agilizar el flujo de bienes necesarios para atender la pandemia. No obstante, la aplicación de algunas de estas medidas, de forma permanente, implicaría un avance significativo en materia de facilitación del comercioItem Análisis de la regulación del comercio electrónico en el marco de las directivas europeas(LEAD University, 2021-01-14) Ocampo Sánchez, Jorge ErnestoLos avances tecnológicos han llevado a nuestro mundo a una vertiginosa transformación, entre los que se encuentra la forma en que se ha migrado paulatinamente del comercio presencial al comercio electrónico. Esto ha provocado que se deba regular todos los aspectos relacionados con esta nueva forma de comercio, en donde la Unión Europea ha estado a la vanguardia de las regulaciones de las nuevas realidades tecnológicas que se van presentando en nuestra nueva realidad. Dentro de su normativa, la Unión Europea ha establecido Directivas con relación al Comercio Electrónico, así como otras Directivas y Reglamentos en todos los aspectos relacionados con esta nueva modalidad, como son la protección de datos, los derechos de los consumidores, la contratación a distancia, el dinero electrónico y los servicios de pago, la fiscalidad, las tecnologías de seguridad de la información y el derecho a la competencia. En este trabajo se hace un breve análisis de estas regulaciones y la forma en que ha incidido en el Proyecto de Ley de Mercado y Comercio Electrónico que está a la espera de ser discutido por nuestra Asamblea Legislativa.Item La revolución creativa como motor económico(LEAD University, 2021-01-14) Gordienko López, AbrilLa creatividad ha estado en la raíz de todos los avances industriales, tecnológicos y socioeconómicos de la humanidad desde muchos siglos antes de su reconocimiento como factor económico. Conocida comúnmente como economía naranja, este término resulta insuficiente para definir el fenómeno multidimensional de la economía creativa. Ha sido en el s. XXI que se ha reconocido expresamente el impacto que tienen sobre la economía mundial las actividades fruto del intelecto y la creatividad; además, su potencial para impulsar las economías de los países en vías de desarrollo es ampliamente reconocido. La pandemia por la Covid-19 ha golpeado con particular fuerza a las actividades y servicios culturales y creativos. Es imperativo que los gobiernos le den a ese sector de la economía la importancia que amerita y a través de política pública pertinente y oportuna, creen un ecosistema propicio para su máximo desarrollo.Item La zona de Cachemira: testigo de tensiones que esboza la gravedad de una disputa sin resolver(LEAD University, 2021-01-14) Umaña Vargas, JorgeChina, India y Pakistán son tres países ubicados en el inmenso continente asiático que colindan entre sí. Son naciones que han sabido potenciar sus características, en especial después de los acontecimientos acaecidos en la Segunda Guerra Mundial. En términos generales, son reconocidos por ser economías emergentes interesantes. Pero ante todo este panorama positivo, algo que debería llamar la atención de toda la comunidad internacional los une: Cachemira. Este artículo explicará por qué.
